On October 24th, former Celsius CEO ALEX Mashinsky will make his first appearance in a New York court in months to participate in oral arguments related to his motion to dismiss the charges against him. According to documents from the Southern District Court of New York on October 23, Judge John Koeltl ordered Mashinsky and the prosecutor to appear in court on November 13 to "reserve testimony" and consider the motion to dismiss part of the prosecution raised by the former Celsius CEO. In January of this year, Mashinsky's lawyer filed a motion to dismiss the allegations of commodity fraud and market manipulation.
